The distance selling regulations
These give you the right to change your mind and cancel an order within seven working days. If you decide to cancel, then you should put this in writing, either by letter (proof of postage or recorded delivery is required), Fax or E-mail. A telephone call is not sufficient.
The time limits are:
For Goods – Seven working days after the day on which the goods are received.
For Services – Seven working days after the day on which you agreed to go ahead with the agreement
If the trader has not provided you with the required information about your right to cancel, then the cooling-off period will be longer – take some advice on this, if necessary
You must take care of the goods whilst they are in your possession, and either return them or make them available for collection by the seller. We will charge you the cost of collecting the goods or you will have to pay the return postage – unless the goods are faulty in the first place.
If you decide to return the goods within these time limits, you are entitled to expect your money to be refunded within 30 days.
What isn’t covered by this cooling off period?
We offer no guarantee on electrical parts, these parts are sold as is.
Services that are to be provided within 7 working days. If you have agreed that the service will start before the end of the cooling-off period you will not be entitled to cancel once the service has started, but we will tell you in writing.
Protection for credit cards
If somebody uses your card fraudulently or dishonestly (without your knowledge) for any kind of distance purchase, you can cancel the payment and the card issuer must refund you. You should notify your issuer as soon as possible after you discover this fraudulent use or if your card has been stolen.
OUR TERMS AND CONDITIONS
EnginesandGearboxes.co.uk hereinafter known as ‘The Company’
The customer/buyer or their representative hereinafter known as ‘The Customer’
1. Goods supplied must be checked for suitability and tolerance prior to fitting or preparation. The Company holds no responsibility for incorrectly ordered parts. The responsibility lies with the Customer/fitter to ensure that the parts ordered are correct.
2. The Company is not responsible for any consequential loss or costs incurred from the fitting of parts.
3. All delivery and installation dates are given as estimates only and The Company shall not be liable for any costs, damages or expenses incurred by the Customer or any other person or Company howsoever arising whether directly or indirectly out of failure to meet the estimated delivery or installation date.
4. The Customer shall immediately inspect the goods supplied and shall inform The Company within seven days of such delivery give notice to The Company of any problems arising from such delivery and make a note of the alleged damage on the delivery/consignment notice.
5. If the goods are damaged in transit, then The Customer should refuse delivery of the part and these shall be returned to the Company.
6. If the Customer shall fail to give notice as required above within seven days then the parts shall be deemed in all respects to be in accordance with the contract and the Customer shall be deemed to have irrevocably and unconditionally accepted the parts as being satisfactory.
7. If the goods have been signed for as ‘received in good condition’ the Company can not be held liable if it is noticed at a later time that the goods are damaged
8. The Company will repair or replace free of charge any of the parts damaged or lost in transit provided the Customer shall give The Company notification of such damage or loss within seven days as in accordance of the above. Any claim outside this period will not be accepted.
9. The Company hereby expressly excludes to the extent permitted by law any liability arising for
a. Consequential loss or damage caused by or arising out of the use of the parts or occurring in respect of the equipment and
b. Loss or damage due to fair wear and tear and negligence or improper use, operation, storage or handling of the parts other than strictly in accordance with The Company’s written instructions as supplied with the parts.
10. Any warranty given on the parts will be void if they are tampered with in any way. Parts must be returned in the same condition as purchased.
11. The Company will not be held responsible for any labour charges incurred during the fitting of parts supplied in the event of any subsequent claim arising from wrongly delivered, delayed or damaged parts.
12. The Company will not be held responsible for any charges incurred in respect of ‘loss of use’ for any time that the vehicle is not being used due to the fitting of parts supplied either by the Customer or his representative. The Customer will meet any extra labour costs incurred in refitting parts.
13. We strongly recommend that only a specifically trained technician fit all safety critical parts. No liability can be accepted for malfunction, damage or injury caused by inappropriate fitting of such components.
14. All parts correctly supplied and returned are subject to a handling charge of 25% and shall be returned at the Customer’s expense.
15. If the Customer is not a trade Customer then the following provisions as to payment apply: -
a. If the goods are in stock and the Customer intends to collect then payment must be made in full by the Customer on collection. If the goods are to be delivered to the Customer then payment must be made by the Customer in advance of delivery. In return, the Company agrees to deliver the goods within seven days of payment having been received.
b. If the goods are not in stock and if the Customer is collecting he must collect the goods within seven days of notification by the Company that they are ready for collection and the Customer will become liable for payment after seven days of such notification regardless of whether or not the Customer has collected the goods. If the goods are to be delivered then the Customer must pay for the goods within seven days of notification that the goods are in stock in return for which the Company agrees to deliver the goods to the Customer within seven days of payment.
16. If the Customer is a trade Customer then unless credit terms have been agreed with the trade Customer in advance, payment is to be made by the trade Customer as if he were a non-trade Customer as provided for in Paragraph 15 above.
17. All used engines and gearboxes have a three month unlimited mileage warranty. All other parts have a thirty-day warranty. These warranties are only effective if
a. The Customer gives written notification of the fault to the Company within seven days of the fault becoming apparent and
b. If the goods have not become faulty by reason of neglect or misuse by the Customer or by reason of the goods being properly fitted.
